1. Acceptance of Terms

By accessing or using WedKit ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, you may not access or use the Service.

These Terms apply to all users of the Service, including without limitation users who are browsers, vendors, customers, merchants, and contributors of content.

2. Description of Service

WedKit is a comprehensive wedding management platform that provides tools for creating wedding websites, managing guest lists, handling RSVPs, organizing meal selections, creating seating arrangements, and communicating with guests via email and SMS.

The Service includes features such as customizable wedding websites, guest management, RSVP tracking, meal planning, seating charts, photo galleries, email and SMS messaging, analytics, and related administrative tools.

3. User Accounts and Registration

3.1 Account Creation

To use certain features of the Service, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

3.3 Account Responsibility

You are responsible for all content posted, data uploaded, and actions taken through your account. You agree not to share your account credentials with third parties.

4. Free Trial and Payment Terms

4.1 Free Trial

We offer a 7-day free trial period. During the trial, you have full access to all features of the Service. No credit card is required to start your trial.

4.2 Payment

After the trial period, continued use of the Service requires a one-time payment of $49 CAD. This payment includes 6 months of hosting and access to all features. There are no recurring monthly fees.

4.3 Payment Processing

Payments are processed through a third-party payment processor (currently Polar). By making a payment, you agree to the payment processor's terms and conditions. We do not store your full payment card information.

4.4 Refund Policy

We offer a 14-day money-back guarantee from the date of payment. To request a refund, email support@wedkit.ca within 14 days of payment and we'll process it manually. No questions asked.

4.5 Service Suspension

If payment is not completed after the trial period, your Service will be paused. All data will be preserved and restored immediately upon payment completion.

5. User Content and Conduct

5.1 User Content

You retain ownership of all content you upload, post, or transmit through the Service ("User Content"). By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and display your User Content solely for the purpose of providing and improving the Service.

5.2 Prohibited Content

You agree not to upload, post, or transmit any User Content that:

• Is illegal, harmful, threatening, abusive, or defamatory
• Violates any third-party rights, including intellectual property rights
• Contains viruses, malware, or other harmful code
• Is spam, unsolicited commercial messages, or fraudulent
• Violates any applicable laws or regulations

5.3 Content Moderation

We reserve the right to remove, edit, or refuse to display any User Content that violates these Terms or is otherwise objectionable, in our sole discretion.

6. Limitation of Liability

6.1 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

6.2 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WEDKIT SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

7. Termination

7.1 Termination by You

You may terminate your account at any time by emailing support@wedkit.ca. We'll close the account and delete your data within a reasonable period.

7.2 Termination by Us

We may terminate or suspend your account and access to the Service immediately, without prior notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.

7.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, subject to our data retention policies. Provisions that by their nature should survive termination shall survive.

8. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or through a prominent notice on the Service. Your continued use of the Service after changes constitutes acceptance of the modified Terms.

9. SMS Program Terms

WedKit Wedding Updates is an optional SMS program used to send wedding-related notifications to invited guests on behalf of the couple.

• Message types may include invitations, RSVP reminders, meal-selection reminders, seating updates, and day-of event reminders.
• Message frequency varies by wedding activity.
• Msg & data rates may apply.
• Reply STOP to unsubscribe at any time.
• Reply HELP for help.
• Consent is collected directly from guests on the RSVP page.
